Türkiye's crypto tax debate: what is actually on the table in 2026

2026-09-19

“Türkiye has introduced a crypto tax” and “crypto is tax-free in Türkiye” have both circulated this year. Neither is a safe summary. Parliament received a detailed tax proposal in March 2026, but its crypto-tax articles were withdrawn before enactment. Meanwhile, licensing and anti-money-laundering rules for platforms are already law. Keeping those tracks separate is the only way to understand the current position.

What Parliament was asked to pass

The March proposal would have created a transaction tax of 0.03% on crypto sales and transfers handled by crypto-asset service providers. It also proposed withholding rules for gains. These were concrete clauses in a bill, not rumours, but a bill is not law merely because it reaches Parliament.

What happened next

During the 26 March plenary process, the articles covering the crypto transaction tax and taxation of crypto gains were withdrawn. The proposed 0.03% charge therefore did not become an automatic levy on every crypto sale or transfer. Any page that describes it as a tax already collected from users is mixing a withdrawn proposal with enacted law.

What is already law

Türkiye's 2024 Capital Markets Law amendment brought crypto-asset service providers under the Capital Markets Board, and detailed operating and capital rules followed in March 2025. Those rules govern platforms, custody, records and supervision. They are not the same as a new personal tax on every holder or every wallet-to-wallet transfer.

What remains genuinely unclear

With the crypto-specific tax clauses withdrawn, individual treatment can still depend on the nature and regularity of activity and on general tax law. A one-off personal disposal, frequent trading as a business and income earned for services are not necessarily the same case. We will not turn that uncertainty into a universal tax rate: the answer depends on facts and future guidance.

The useful step now is record-keeping

Keep the date, assets, amounts, local-currency value at the time, fees, transaction hashes and wallet or provider records for every swap. No-account or no-ID crypto-to-crypto swapping describes the service flow; it does not cancel a tax duty that may apply to you. This article is general information as of 19 September 2026, not tax or legal advice. Ask a qualified adviser in Türkiye about your circumstances.
