The CLARITY Act Stalled. The Regulators Moved Anyway

2026-09-18

Crypto's long-awaited US market-structure bill did not make it. In mid-September 2026 a procedural vote on the CLARITY Act drew 49 votes against 50, short of the 60 needed to advance. Two days later the agencies the bill would have re-organised acted under the powers they already have. For anyone who just wants to move coins between wallets, the headline and the consequence point in different directions.

What failed

The CLARITY Act was the attempt to settle in statute which US regulator oversees which digital asset, and on what terms. Its procedural vote failed 49-50. That leaves the industry without a comprehensive framework and puts the weight back on what the SEC and CFTC can do under existing law — which, as the following days showed, is more than many expected.

What the SEC did instead

On 17 September the SEC granted temporary, conditional relief creating a category of Tokenised Securities Venue: blockchain-based venues may bring together buyers and sellers of tokenised US equities through permissioned automated market makers without registering as an exchange. The relief runs five years, and Chair Paul Atkins tied it explicitly to the stalled legislation. Industry bodies including SIFMA and Cboe had argued that rulemaking, not exemption, was the right route — that disagreement has not gone away.

And the CFTC

The same week, the CFTC — which would have become the primary regulator under CLARITY — sent an action titled 'Regulation Crypto Asset Transactions and Regulation Crypto Asset Markets' to the White House for review. It sits at the early 'prerule' stage, so the substance is not public yet. The direction is the point: both agencies signalled they will proceed with or without new law.

What it means if you just swap coins

Almost nothing changes this month, and that is worth saying plainly rather than dressing a legislative story up as urgent news for you. Tokenised-equity venues are a different market from swapping BTC for XMR. What the episode does confirm is the longer trend behind most of the disruption people actually feel: rules for regulated intermediaries keep tightening, and custodial platforms absorb that first — through listings, regional availability and verification demands. A non-custodial swap avoids the custody question entirely, because nobody is holding your balance while the rules are argued over. It is not a shield from law, and we would not claim it is; it is simply one less counterparty between you and your coins.
